Terms of Service

Shokken GO is operated by Tanpopo Games, LLC ("we," "us"), a Texas limited liability company. These Terms of Service ("Terms") are a binding agreement between you and Tanpopo Games, LLC governing your use of shokkengo.com and the Shokken GO app (the "Service"). If you do not agree to these Terms, please do not use the Service.

To use most features you create an account, either with an email address and password or by signing in with Google. You agree to provide accurate information and keep it up to date. You are responsible for your account, for keeping your login credentials secure, and for everything that happens under your account. Accounts are for individuals — one person per account. Tell us promptly if you suspect unauthorized use of your account.

You must be at least 13 years old to use Shokken GO (16 in the European Economic Area and the UK). By using the Service, you confirm that you meet this requirement. The Service is not intended for children below these ages.

You agree to use Shokken GO only for lawful, personal learning. You will not:

• access another user's account or data without permission;
• scrape, copy, or harvest the Service's content, or place an unreasonable load on our systems;
• reverse-engineer, decompile, or attempt to extract the app's source code, except where the law expressly permits it;
• use the Service to break the law or infringe anyone's rights; or
• interfere with or disrupt the Service or its security.

Shokken GO offers a free tier and a paid "Pro" subscription.

• Billing. Paid subscriptions are processed by Stripe. By subscribing, you authorize us, through Stripe, to charge your payment method on a recurring basis.
• Renewal and cancellation. Subscriptions renew automatically until you cancel. You may cancel at any time; cancellation takes effect at the end of your current billing period, and you keep Pro access until then.
• Price changes. We may change subscription prices, but we will give you advance notice, and changes apply to the next billing period.
• Taxes. You are responsible for any applicable taxes.
• Refunds. All fees are non-refundable except where required by law.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Shokken GO for your own, non-commercial learning. You may not resell, redistribute, or commercially exploit the Service or its content.

Shokken GO — including its software, design, text, and the menu simulations — is owned by Tanpopo Games, LLC and protected by intellectual-property laws. "Shokken GO" and our logo are our trademarks. The menu simulations are practice aids created for learning; they are not operated by, affiliated with, or endorsed by any restaurant, brand, or business they may resemble. You may not use our trademarks or content without our permission.

If you send us feedback, ideas, or suggestions, we may use them to improve Shokken GO without any obligation or compensation to you.

Shokken GO depends on third-party services, including Stripe (payments) and Google (sign-in and audio). Your use of those services may be subject to their own terms, and we are not responsible for them.

Shokken GO is provided "as is" and "as available," without warranties of any kind, whether express or implied. Shokken GO is a learning aid: we do not guarantee that practicing with it will produce any particular real-world result, that every menu or detail is accurate or current, or that the Service will be uninterrupted or error-free.

To the fullest extent permitted by law, Tanpopo Games, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $100.

You agree to defend and indemnify Tanpopo Games, LLC from any claims, damages, and costs (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or of any law or third-party right.

You may stop using Shokken GO and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we need to for legal or security reasons. When your account ends, your right to use the Service stops; sections that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, and indemnification) will remain in effect.

We may update the Service and these Terms from time to time. For material changes to the Terms, we will provide notice (such as an in-app message or by updating the "last updated" date). Your continued use of Shokken GO after a change means you accept the updated Terms.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction.

You represent that you are not located in, and will not use Shokken GO from, a country or region subject to comprehensive U.S. economic sanctions, and that you are not on any U.S. government list of restricted parties. You agree to comply with all applicable export-control and sanctions laws.

These Terms are the entire agreement between you and Tanpopo Games, LLC about the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates an agency, partnership, or employment relationship.
